It turns out that the penguin photo used in that meme belongs to National Geographic, and you have to pay Getty Images (a photo licensing company) to use it. This came to light a few years ago when\u00a0<a href=\"https:\/\/www.getdigital.de\/blog\/getty-images-wants-license-fees-for-the-awkward-penguin-meme\/\" target=\"_blank\" rel=\"noopener\">GetDigital received a letter from Getty Images<\/a>\u00a0demanding 785 EUR (that\u2019s about 941 US dollars) for using the penguin meme in one of their blog posts.<\/p>\n<p>This not an isolated incident either. A google search for the now infamous \u2018Getty Letter\u2019 reveals that plenty of small businesses have received legal threats from Getty Images over use of this meme. Also, in 2013,\u00a0<a href=\"https:\/\/www.iptrademarkattorney.com\/2013\/04\/los-angeles-copyright-trademark-sue-attorney-keyboard-cat-nyan-cat-meme-viral-videos.html\" target=\"_blank\" rel=\"noopener\">Warner Bros and 5th Cell Media found themselves in hot water<\/a>\u00a0for using the Keyboard Cat and Nyan Cat memes in their\u00a0<em>Scribblenauts<\/em>\u00a0game without permission from the creators. Recently, rapper\u00a0<a href=\"http:\/\/www.nydailynews.com\/entertainment\/ludacris-sued-posting-boob-sweat-cartoon-instagram-article-1.3289651\" target=\"_blank\" rel=\"noopener\">Ludacris faced a lawsuit from Little Things<\/a>\u00a0for a photo that he posted on his Instagram account. And what about the immensely popular Crying Jordan meme? The Associated Press (which owns the rights to the photo) and Michael Jordan are both\u00a0<a href=\"http:\/\/www.espn.com\/nba\/story\/_\/id\/14788779\/can-wildly-popular-often-hilarious-crying-michael-jordan-meme-get-sued\" target=\"_blank\" rel=\"noopener\">keeping a close eye on the use of that meme<\/a>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Memes-that-are-hurtful-or-defamatory\"><\/span>Memes that are hurtful or defamatory<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Another common problem pertains to memes that are hurtful or defamatory. Dancing with the Stars\u2019 Val Chmerkovskiy learned this the hard way \u2013 in the form of a\u00a0<a href=\"http:\/\/www.foxnews.com\/entertainment\/2016\/02\/01\/val-chmerkovskiy-sued-for-6m-over-meme-shared.html\" target=\"_blank\" rel=\"noopener\">$6 million lawsuit<\/a>. The issue stemmed from Chmerkovskiy tweeting out the photo of a young girl with Down Syndrome, bearing the caption: \u2018<em>Letting your kid become obese should be considered child abuse.<\/em>\u2019 The girl\u2019s family sued Chmerkovskiy for infliction of severe emotional distress, and they also sued the photographer who took the photo for invasion of privacy. Similarly, Matt Furie recently sent\u00a0<a href=\"https:\/\/motherboard.vice.com\/en_us\/article\/ne7nzz\/here-are-the-letters-that-pepe-the-frogs-lawyers-sent-to-the-alt-right\" target=\"_blank\" rel=\"noopener\">DMCA take down notices<\/a>\u00a0to \u2018alt right\u2019 groups that he claims use his Pepe the Frog meme to promote hate. Not every such incident results in a lawsuit (many are settled following a cease and desist notice), and not every lawsuit ends up being successful. However, the damage can still be significant and long lasting.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"You-have-a-choice-to-make\"><\/span>You have a choice to make<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>What is the takeaway from these examples? If you come across a meme that you didn\u2019t create, chances are that someone else owns that content. And if your meme is hurtful \u2013 intentional or not \u2013 you may also be opening yourself up to liability. You are essentially playing Russian roulette whenever you share a meme that is not your own original work or not very well thought out. Maybe you will get lucky and no one will bother you. Maybe you will find yourself facing hefty fines or a lawsuit. It is ultimately for you to decide whether you are willing to roll the dice and how much risk you are willing to take on.
